EBay wins lawsuit against Tiffany & Co.
Tiffany joined up in a string of lawsuits against EBay, but to no avail.
The federal Judge said companies such as the jeweler Tiffany & Co. are responsible for policing their trademarks online, not auction platforms like EBay.
Tiffany attempted to sue EBay in 2004, arguing that most of Tiffany-branded items sold on EBay were fakes.
U.S. District Judge Richard J. Sullivan in NY ruled that EBay can not be held responsible for trademark infringement “based solely on their generalized knowledge that trademark infrigement might be occurring on their Web sites.”
Tiffany had notified EBay of counterfeit goods and EBay had removed such listings, although they did not take further action the judge said EBay didn’t even have to take such action.
